CHATTANOOGA, Tenn. (WKRN) – A mother has filed a lawsuit after her daughter suffered serious injuries in a school bus accident that claimed the lives of six students and injured several more.
The lawsuit against the bus driver and Durham School Services was filed by Shanquatta Byrd, on behalf of her daughter, who was on-board the bus when it crashed on Tally Road on November 21.
The lawsuit alleges the driver, Johnthony Walker, was driving “at an excessive speed and lost control of the bus causing it to flip over.”
Byrd says her daughter “suffered a traumatic brain injury and multiple orthopedic injuries as a result of the incident.”
“It is heartbreaking whenever children are involved, especially when the crash was as preventable as this one appears to be,” attorney Joseph Fried said in a release.
He continued, “This beautiful child now faces a long and difficult road to recovery with years of rehabilitation and likely permanent difficulties and deficits. The family wants to know why this had to happen and what can be done to prevent these kinds of tragedies in the future. This lawsuit is the first step in answering those questions.”
Walker, the 24-year-old bus driver, has since been arrested and is charged with vehicular homicide. He remains jailed.
The investigation is ongoing.
