News 2 confirmed Petrina’s parents filed a lawsuit against Dean Diver, 72, of Ohio, the driver who struck and killed Petrina.

Petrina, 25, was assisting a Tennessee Department of Transportation Help truck operator with an accident at the Old Hickory Boulevard exit when he was struck by Driver’s motorhome carrying a trailer.

At the time of his death, Petrina had only been on the force less than a year.

Diver told police he could not change lanes because of traffic. He stated he was trying to drive in between the TDOT truck and the officer’s cruiser.

Nashville attorney Josh Offutt, who represents Diver in the civil case, told News 2 the paperwork has been served but provided no additional details.

Driver faces criminal charges for reckless homicide and failure to yield. He is scheduled to appear in court May 29.
