Wagner reported to police that he ran out of gas near the fire hall located on 2nd Avenue South on May 18 and went inside the station.

During their investigation, detectives learned victim's credit card was used soon after to purchase two cartons of cigarettes at the Kroger on Monroe Street.

Wagner recorded by video surveillance purchasing the cigarettes.

He is jailed in lieu of $5,000 bond on charges of burglary and fraudulent use of a credit card.
