A grand jury will hear the case against a Nashville man who was allegedly intoxicated when he hit a woman with his vehicle last week.
Police arrested Gregory Capps last Wednesday evening after the SUV he was driving hit and injured Theresa Lawton.
Metro police said Capps, 43, was traveling south on East Marthona Road in Madison when the collision occurred.
Capps told officers he didn't see Lawton, who was on her way to church.
“Theresa had landed in front of the vehicle and at that point I'm running after him screaming for him to stop-because the next thing I'm thinking is he's going to run over my wife a second time,” Theresa's husband Richard said.
Officers detected an odor of alcohol on Capps and he was charged with felony vehicular assault and driving on a revoked license.
Lawton, 52, remains in critical condition at Vanderbilt University Medical Center.
