The Contest is offered only to legal U.S. residents who are eighteen (18) years of age or older at the time of entry and reside in WKRN-TV's Designated Market Area (“DMA”) as determined by Nielsen Media Research Services. This area covers the following counties in the Nashville area: Allen; Barren; Christian; Clinton; Cumberland; Logan; Monroe; Muhlenberg; Simpson; Todd; Trigg; Warren; Bedford; Benton; Cannon; Carroll; Cheatham; Clay; Coffee; Cumberland; Davidson; Decatur; De Kalb; Dickson; Fentress; Franklin; Giles; Grundy; Hardin; Henry; Hickman; Houston; Humphreys; Jackson; Lawrence; Lewis; Lincoln: Macon; Marshall; Maury; Montgomery; Moore; Morgan; Overton; Perry; Pickett; Putnam; Robertson; Rutherford; Scott; Smith; Stewart; Sumner; Trousdale; Van Buren; Warren; Wayne; White; Williamson; Wilson counties. Employees of WKRN-TV, Young Broadcasting of Nashville, LLC, WKRN G.P., Young Broadcasting LLC, and each of their subsidiaries, parents, affiliates, representatives, and agents, and the directors and employees (collectively, “Contest Entities”) and of other media companies and members of the immediate families and members of the same households of such individuals are not eligible. The term “immediate families” includes spouses, grandparents, parents, siblings, children and grandchildren. No groups, clubs, or organizations may participate in this Contest or reproduce or distribute any portion of these Official Rules to their members. Proof of age, identity, and eligibility must be furnished to Sponsor upon request. All information provided to Sponsor must be complete and accurate. Sponsor will not award a prize to anyone not meeting eligibility requirements at the time of entry. By entering, you agree to comply with all applicable law and these Official Rules, and you agree to abide by all decisions of the Sponsor. Sponsor reserves the right to disqualify any entrant if these Official Rules are not followed. Limit one winner per household. Limit one winner per immediate family. Prizes are non-transferable.
3. HOW TO ENTER
By entering the Contest, all entrants acknowledge receipt of, agree to, and certify compliance with these Official Rules. All dates and times are subject to change in the event of human error or technical issues affecting WKRN-TV, the entry process, or relevant on-air programming or in the event of breaking news, weather, or live event that merits, in WKRN-TV's sole discretion, the preemption of the scheduled programming, including the Contest or display of the Cue to Call, or that is of greater public importance, in the Sponsor's sole discretion, than the timely or precise execution of the Contest. In the event of any such event, condition, or programming change or preemption, WKRN-TV reserves the right, in its sole discretion, to delay, reschedule, or omit the presentation of the Cue to Call and/or the Entry Period on or from the particular day affected. The Contest will run on weekdays beginning on Monday, December 17, 2012, with the airing of WKRN-TV's 5 a.m. newscast. The Contest will end on Friday, December 21, 2012, with the end of the 6 a.m. newscast. Each weekday of the Contest has a separate Entry Period. To participate, watch Nashville's News 2 This Morning at 5 a.m. and 6 a.m. between December 17 and December 21, 2012. On those dates, a “Cue to Call” will be announced or displayed sometime during WRKN-TV's 5 a.m. and 6 a.m. newscast programming (including breaks). Viewers must watch for the Cue to Call, because the Cue to Call signifies the opening of that day's Entry Period. After the Cue to Call is announced or displayed on WKRN-TV, participants may enter the Contest by calling the phone number displayed on the screen (“Contest Line”). The entry deadline for each Entry Period is the earlier of the time at which the twenty-second (22nd) caller calls in or 15 minutes after the end of the 6 a.m. newscast. In order to enter the Contest, you must have access to a telephone. For clarity, it is permissible to use speed dial and redial functionality on telephones but it is not permissible for entrants to simultaneously use multiple phone lines or equipment not generally available to consumers to increase their chances of winning; any such use, if detected by Sponsor, may result in disqualification of the entrant. Standard charges and fees for your telephone service apply. Sponsor is not responsible for entries that are lost, late, misdirected, incomplete, incomprehensible, illegible, damaged, undeliverable or delayed. Photocopied and mechanically generated entries are void. Entries generated by any automated means and detected as such are void.
4. HOW TO WIN
The 22nd caller to the Contest Line for each Entry Period will be the Daily Winner. In the event fewer than 22 calls are received by the deadline of 15 minutes after the end of the 6 a.m. newscast, the last caller will be the Daily Winner. Each Daily Winner will be advised at the time they call that they are the winner. Limit one Daily Prize per person during this Contest. All winners are subject to verification.
Winners may be required to sign and return appropriate forms and/or documentation, including an Affidavit of Eligibility, a Liability Release and/or where legally permissible a Publicity Release prior to or when claiming prize. Failure to sign and return such forms within the requisite timeframe could result in disqualification. Sponsor is not responsible for incomplete, incomprehensible, illegible, or out-of-service contact information. In the event of disqualification of any winner, Sponsor reserves the right to extend the Contest or to give away multiple Daily Prizes on one or more days during the Contest or to not award the prize at all, in Sponsor's sole discretion. Disqualification or ineligibility of a winner will result in forfeiture of his or her interest in all prizes. Prizes will be available to pick up on non-holiday weekdays, Monday through Friday at the front desk of the News 2 Studios at 441 Murfreesboro Road, Nashville, Tennessee, 8:30 a.m. through 5:00 p.m. Prizes must be claimed by December 26, 2012. Please note, offices will be closed December 25, 2012.
Daily Winner Prizes: A total of five (5) Daily Prizes will be offered. Each Daily Prize is two (2) tickets to the Trans-Siberian Orchestra “The Lost Christmas Eve” on December 26, 2012 at the Bridgestone Arena in Nashville at 8 p.m. Each prize is valued at $100-$120. Sponsor reserves the right to substitute a prize of equal or greater value for any reason in the sole discretion of Sponsor if any prize or any component thereof is unavailable for any reason. Prizes are nontransferable by winners. All expenses, fees, and costs not specifically included in the prize descriptions above, including all federal, state, and local taxes, are solely the responsibility of the winner and guest(s).
6. PUBLICITY RELEASE
Except where prohibited, entry in the Contest constitutes each entrant's consent to Contest Entities to use, publish, reproduce and for all purposes, including publicity, promotion and advertising, in any media (including without limitation, the Internet, television, radio, or offline promotions), the Winner's name, city, photograph, likeness, biographical material, voice, image, each in perpetuity without further compensation, credit or right of review or approval.
7. ODDS of WINNING
Odds of becoming a Daily Prize Winner depend on the number of phone calls received and the relative order of their receipt.
8. TERMS AND CONDITIONS; LIMITATION OF LIABILITY
Participants are responsible for complying with all applicable federal, state, and local laws and regulations and with these Official Rules, and by entering, participants agree to be bound to these Official Rules. Sponsor is not responsible for any printing, typographical, mechanical or other error in the printing of the offer, administration of the Contest or in the announcement of the Prize. Sponsor retains the discretion to make all decisions regarding the interpretation and application of these Official Rules. All decisions of Sponsor are final and discretionary. In the event the selected Winner of the Prize is ineligible or refuses the Prize, the Prize will be forfeited and Sponsor, in its sole discretion, may, time permitting, extend the Contest or offer multiple chances to win on one or more remaining Contest days or may elect not to award such Prize. For prizes valued at $600 or greater, Winner must provide his or her Social Security Number for tax purposes. Prize may be considered income, and any and all taxes associated with Prize are the responsibility of the Winner. Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend this Contest or any portion hereof (in which case Sponsor reserves the right to select winners from eligible entries received as of the termination date), or to disqualify any individual implicated in any of the following actions, if for any reason: (a) infection by computer virus, bugs, interruption in calling devices or service, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, human error, or any other causes which, in Sponsor's sole opinion, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, (b) the Contest becomes corrupted due to calling service interruption for any reason (c) acts of God, war, terrorism, government regulation, disaster, fire, strikes, civil disorder, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity of the Contest, (d) Contest is otherwise not capable of running as planned. BY ENTERING, ENTRANTS AGREE TO RELEASE AND HOLD HARMLESS THE CONTEST ENTITIES AND EACH OF THEIR PARENT, SUBSIDIARY COMPANIES, AFFILIATES, DIVISIONS, FRANCHISEES, REPRESENTATIVES, CONSULTANTS, SUB-CONTRACTORS, SUPPLIERS, DISTRIBUTORS, LEGAL COUNSEL, ADVERTISING, PUBLIC RELATIONS, PROMOTIONAL, FULFILLMENT AND MARKETING AGENCIES, AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, SHAREHOLDERS AND AGENTS, AND EACH OF THE FOREGOING ENTITIES' EMPLOYEES, OFFICERS, DIRECTORS, SHAREHOLDERS AND AGENTS (COLLECTIVELY THE “RELEASED PARTIES”), FROM AND AGAINST ANY AND ALL CLAIMS, ACTIONS AND/OR LIABILITY FOR ANY INJURIES OR DEATH, LOSS OR DAMAGE OF ANY KIND ARISING FROM OR IN CONNECTION WITH PARTICIPATION IN AND/OR ENTRY INTO THE CONTEST OR ACCEPTANCE, DELIVERY OR USE OF ANY PRIZE. The Released Parties are not responsible or liable for any incorrect or inaccurate entry information, and assume no responsibility for (i) any error, omission, interruption, defect or delay in operation or transmission at any website, or phone service, interrupted or unavailable network, server or other connections (ii) failure of any entry to be received in whole or in part by Sponsor due to technical problems, phone service problems, busy signals, dropped calls, operator interference, technical or atmospheric conditions that disrupt the completion of the phone call, human error or traffic congestion on the Internet or at any website, or wireless carrier or phone service (iii) communications line, hardware and/or software failures, malfunction of phones (including wireless, wired, IP phones/handsets), phone lines, other communications malfunctions, unavailable network connections, cellular equipment towers, phone systems or service (iv) damage to any computer (software or hardware) resulting from participation in the Contest, or damage to phone or other device (v) theft or destruction of, tampering with, unauthorized access to, or alteration of entries and/or entry information, or (vi) entries which are late, lost, stolen, damaged, misdirected, illegible, and/or unintelligible (or any combination thereof). By entering, entrants agree to comply with these Official Rules and with all decisions of Sponsor. Any entrant who attempts to tamper with this Contest in any way, including cheating, hacking, deception or other unfair playing practices or intending to abuse, threaten or harass other entrants, may be disqualified if detected. SPONSOR MAKES NO WARRANTY, GUARANTEE, OR REPRESENTATION OF ANY KIND CONCERNING ANY PRIZE, AND SPONSOR SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTY OF MERCHANTABILITY, WARRANTY OF FITNESS, AND ANY OTHER IMPLIED WARRANTY.
9. ARBITRATION/CHOICE OF LAW
EXCEPT WHERE PROHIBITED, ENTRANTS AGREE THAT ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF, OR CONNECTED WITH, THIS CONTEST SHALL BE RESOLVED EXCLUSIVELY BY ARBITRATION PURSUANT TO THE RULES OF THE AMERICAN ARBITRATION ASSOCIATION THEN EFFECTIVE, AND ANY AND ALL CLAIMS, JUDGMENTS, AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED BY ENTRANT WITH REGARD TO THIS CONTEST, BUT IN NO EVENT ATTORNEYS' FEES, PUNITIVE, INCIDENTAL, CONSEQUENTIAL, OR OTHER DAMAGES. All issues and questions concerning the construction, validity, interpretation, and enforceability of these official rules, or the rights and obligations of entrants and Sponsors in connection with the Contest, shall be governed by and construed in accordance with the laws of the State of Tennessee, without giving effect to any choice of law or conflict of law rules or provisions (whether of Tennessee or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than Tennessee. Arbitration in Davidson County, Tennessee, shall be the exclusive forum and venue for any dispute relating to these official rules and for this Contest. If arbitration is prohibited, then and in such event, the courts of Tennessee in Davidson County shall be the exclusive forum for any dispute relating to these official rules and/or this Contest. All participants and winners agree, by their participation in the Contest, to submit to the personal jurisdiction of the courts of Tennessee in Davidson County. The invalidity or unenforceability of any provision of these official rules shall not affect the invalidity or unenforceability of any other provision so long as the general intent of these official rules remains in effect. In the event that any such provision is determined to be invalid or otherwise unenforceable, these official rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

Sponsor reserves the right to change, alter, or amend these Official Rules as necessary, in its sole discretion, to ensure the fair administration of the Contest or to comply with applicable law.
