NASHVILLE, Tenn. (AP) – A court ruling means a former Tennessee teacher convicted of having sex with a 13-year-old student could serve out the remainder of her sentence without the chance for parole.

Pamela Rogers pleaded no contest to sexual battery in 2005 for her relationship with a student while she was a teacher in Warren County. She was released on probation in 2006, but was sent back to jail for sending nude photos to the boy.

In 2008, she was denied parole and her next parole hearing was set for 2014. She appealed the decision saying she could be released prior to the hearing.

In a ruling filed Wednesday that was first reported by The Tennessean, the Tennessee Court of Appeals said considering her actions while on probation, the parole board's decision to set the next hearing six years out was not arbitrary.
